This website is operated by Everyday Chemist. Throughout the site, the terms “we”, “us” and “our” refer to Everyday Chemist.  When we refer to "you," we mean the person browsing the Site or buying from us.

By visiting the Site or buying from us, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies referenced here. Please read them before placing an order. If you do not agree to these terms, please do not use the Site.

We may update these terms from time to time. The current version always lives at this URL. Continued use of the Site after a change takes effect means you accept the updated terms.

1. Online store terms

By agreeing to these terms, you confirm that you are at least the age of majority in your province or country of residence (in Ontario, that is 18), or that you are using the Site with the consent and supervision of a parent or guardian.

You agree not to use our products for any unlawful purpose, and not to violate any law in your jurisdiction (including copyright and trademark law) while using the Site.

You agree not to transmit any worms, viruses, or any code of a destructive nature to or through the Site.

A breach of these terms may result in immediate termination of your access to the Site and our services.

2. General conditions

We reserve the right to refuse service to anyone, for any reason, at any time.

You understand that your content (excluding payment details) may be transferred unencrypted across networks and may be adapted to meet the technical requirements of connecting devices or networks. Payment details are always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or commercially exploit any part of the Site, our products, or our content, without our prior written permission.

The headings used in this agreement are for convenience only and do not limit or affect these terms.

3. Accuracy of information on the Site

We do our best to make sure the information on the Site is accurate, complete, and current. The material here is provided for general information only and should not be relied on as the sole basis for any decision, particularly health, medical, or skincare decisions, without consulting more authoritative sources. Any reliance on the material on this Site is at your own risk.

This Site may contain historical or archival information that is no longer current. We are not obligated to update it.

4. Modifications to the service and prices

Prices for our products are listed in Canadian dollars (CAD) and are subject to change without notice. We reserve the right to modify or discontinue any product, bundle, or service (or any part of it) at any time, without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product or service.

5. Products

Because we make every batch by hand in our Toronto lab, certain products may be available exclusively online, in limited quantities, or seasonally. We may limit the sale of our products to any person, geographic region, or jurisdiction at our discretion.

We have made every effort to display the colours, finishes, and textures of our products as accurately as possible. We cannot guarantee that your monitor or device will display colour accurately.

Product descriptions, ingredient lists, and pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

We do not warrant that any product will meet your expectations. If you are unhappy with your purchase, please contact us at hi@everyday-chemist.com and we will work with you to make it right.

6. Order accuracy and acceptance

We reserve the right to refuse, limit, or cancel any order at our sole discretion. This includes orders that appear to be placed by resellers, orders that appear fraudulent, and orders we believe in good faith violate these terms.

You agree to provide current, complete, and accurate purchase and account information for every order you place with us, and to keep your account details up to date so that we can fulfil your order and contact you when needed.

7. Shipping, returns, and cancellations

Shipping, returns, and cancellation terms are described in our FAQ and at checkout. Because we manufacture products to order in small batches, we are not always able to cancel an order after it has entered production. We will always try.

If a product arrives damaged or you are otherwise unhappy with your order, please email hi@everyday-chemist.com within 30 days of receiving it and we will work with you to make it right.

8. Optional tools and third-party links

We may provide access to third-party tools (for example, customer review platforms or chat widgets) that we neither monitor nor control. You acknowledge that we provide access to these tools "as is" and "as available," without any warranty or representation. Your use of any third-party tool is at your own risk.

Certain content, products, and services available on the Site may include materials from third parties (for example, ingredient databases, blog content, or stockist links). Third-party links on the Site may direct you to other websites that are not affiliated with us. We are not responsible for the content, accuracy, or practices of third-party websites, and we are not liable for any loss or damage related to your use of them.

If you send us comments, suggestions, ideas, photos, reviews, or other content (whether by email, social media, our review platform, or any other means), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use that content in any medium and for any purpose, including marketing. We are under no obligation to keep your submission confidential, to compensate you for it, or to respond to it.

You agree that your submissions will not violate any third party's rights (including copyright, trademark, or privacy), will not contain anything unlawful or abusive, and will not include any malicious code. You are solely responsible for the content of your submissions and for their accuracy.

11. Errors, inaccuracies, and omissions

Occasionally there may be typographical errors, inaccuracies, or omissions on the Site, including in product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any such errors and to update or cancel an order if any information on the Site is inaccurate, even after you have submitted your order. We will refund you in full if we cancel an order on this basis.

We are not obligated to update or amend information on the Site, except as required by law.

12. Prohibited uses

In addition to the prohibitions in section 1, you are prohibited from using the Site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any international, federal, provincial, or local regulation; to infringe on our intellectual property rights or the rights of others; to harass, abuse, defame, or discriminate against any person or group; to submit false or misleading information; to upload or transmit malicious code; to collect or track the personal information of others; to spam, phish, or scrape; for any obscene or immoral purpose; or to interfere with the security of the Site or any related infrastructure. We reserve the right to terminate your access to the Site for any violation of these prohibitions.

13. Disclaimer of warranties; limitation of liability

We do not guarantee that your use of the Site will be uninterrupted, timely, secure, or error-free.

You expressly agree that your use of, or inability to use, the Site and our products is at your sole risk. Except as expressly stated by us, our products and services are provided "as is" and "as available," without any representation, warranty, or condition of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

In no case will EC Studios Inc., Everyday Chemist, our directors, officers, employees, contractors, suppliers, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost data, or replacement costs, arising from your use of the Site or any product purchased through it, even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless EC Studios Inc. and Everyday Chemist, including our directors, officers, employees, agents, contractors, suppliers, and service providers, from any claim or demand, including reasonable legal fees, made by any third party as a result of your breach of these terms, your violation of any law, or your violation of the rights of a third party.

15. Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision will still be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed from the rest of these terms. The remaining provisions will continue in full force and effect.

16. Termination

These Terms and Conditions are effective until terminated by either you or us. You may terminate them at any time by no longer using the Site. We may terminate them at any time, without notice, if we believe you have failed to comply with them, in which case you will remain liable for all amounts owed to us up to and including the date of termination.

Obligations and liabilities incurred before the termination date survive the termination of this agreement.

17. Entire agreement

Our failure to exercise or enforce any right or provision of these Terms and Conditions does not constitute a waiver of that right or provision.

These Terms and Conditions, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and us regarding your use of the Site and our products, and supersede any earlier agreements or communications.

Any ambiguity in the interpretation of these terms will not be construed against the drafting party.

18. Governing law

These Terms and Conditions, and any separate agreements through which we provide you products or services, are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these terms or your use of the Site will be brought exclusively in the courts located in Toronto, Ontario, and you consent to the personal jurisdiction of those courts.

It is your responsibility to check this page from time to time for changes. Your continued use of the Site after any change is posted constitutes acceptance of the updated terms.
